What Are the Hours of Service Regulations?

Because trucks can be so dangerous to other motorists when an accident happens, truck drivers are required to follow more regulations than other drivers. One of these truck driver specific rules, are called the hours of service regulation which are aimed primarily at preventing fatigued driving, a major cause of accidents. According to these rules:

  • Truck drivers can work up to 14 hours in a day but can only drive for 11 hours. The remaining hours must be spent on rest or meal breaks.
  • Drivers must rest for at least 10 consecutive hours before starting a new workday.
  • Truck drivers are required to take days off work at regular intervals.

Who is Liable After a Truck Accident?

When it comes to truck accident liability the party most often found liable is the trucking company. While there are many reasons for this the main one is that trucking companies are often caught encouraging or expecting their drivers to break truck regulations in order to save their company time or money.

At times the truck driver is held liable, particularly if the accident was caused directly by their negligence. Although it happens less often, there are other parties that can be found liable. Some of these parties include the truck manufacturer or cargo loading team. Kwartler Manus, LLC is experienced in investigating truck accident claims and is ready to help you.

How Truck Accidents Can Occur

Driving next to a semi-truck on a highway can be nerve-wracking… and for good reason! A collision with a truck does not tend to look good for the smaller vehicle. Truck accident injuries can be devastating, resulting in broken bones, bruises, head and neck injuries, whiplash, trauma, paralysis, quadriplegia, paraplegia, and even death. Because of the extreme risk to other vehicles, truck drivers are required to participate in special training and are held to a higher standard legally.

For example, truck drivers are considered commercial drivers (if their truck weighs more than 26,001 pounds), so they be charged with a DUI if their BC level is at or above 0.04 percent. Despite these stricter regulations for truck drivers, studies show that in the years 2011-2015, there were 31, 873 truck-related accidents in Pennsylvania. According to FMCSA, causation for the crash much more likely to be a fault of the driver than other factors, and most often, the crash occurs as a collision with another vehicle.

Just a few of the causes of truck accidents include:

  • Jackknifing (accidental folding of a semi-truck)
  • Swerving
  • Falling asleep at the wheel
  • Improper driver training
  • Brake malfunction
  • Speeding
  • Tire defects
  • Drunk driving
  • Unsecure load
  • Distracted, negligent, or reckless driving
  • Improper vehicle maintenance
